Mehralian<\/i>, a case under the <i>Children\u2019s Law Reform Act<\/i>, which is to be heard by the Supreme Court of Canada on December 9<\/span><span class=\"s2\"><sup>th<\/sup><\/span><span class=\"s1\">, 2024. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">At issue in the case is the determination of the \u2018habitual residence\u2019 of a child who resided<span class=\"Apple-converted-space\">&nbsp; <\/span>both in Canada and in a country that is not a signatory to the Hague Convention on International Child Abduction.<span class=\"Apple-converted-space\">&nbsp; <\/span>This case has the potential to produce harmful precedent for vulnerable children in Canada particularly those touched by an immigration process.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cCanada must always strive to ensure the rights of all children afforded to them under the United Nations Convention on the Rights of the Child are realized\u201d , said Irwin Elman, President, Defence For Children International \u2013 Canada, \u201c<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The position of DCI \u2013 Canada<span class=\"Apple-converted-space\">&nbsp; <\/span>before the Supreme Court is that the habitual residence analysis undertaken by the Court must take into account the reality of the child, and be consistent with a child\u2019s human rights under the <i>Child Convention on the Rights of the Child<\/i>, the <i>Hague Convention<\/i>, and the <i>Canadian Charter of Rights and Freedoms. <\/i><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Elman said, \u201cChildren have the right to be heard.
